Kenya has made significant progress in tobacco control since ratifying the World Health Organization’s Framework Convention on Tobacco Control (FCTC)1 in 2004. This commitment aimed to reduce tobacco consumption through public education, stricter regulations, and the implementation of graphic health warnings (GHWs) on tobacco packaging. Despite opposing the 2014 Regulations, BATK implemented three of the 15 GHWs on cigarette packets only in September 2016 while awaiting the court's decision. The company eventually lost the case at every level, including the Supreme Court of Kenya in 2019. However, new tobacco products, including oral nicotine pouches, vapes, and e-cigarettes, continue to be sold in Kenya without graphic health warnings. This report exposes BATK’S Strategies to undermine the development of Graphic Health Warnings in Kenya.
